1. Informative use of our website

a. Technical provision of our website

Collection of general information
The technical provision of our website requires that we process certain automatically transmitted information from you, so that your browser can display and you can use our website. This information is automatically collected each time you visit our website and stored in our server log files. The following information is collected: IP address, date and time of access, time zone difference to Greenwich mean time (GMT), browser type / version, browser language, OS used and its interface, amount of data transferred, requesting site, access status / HTTP status code.

d. Google AdWords

Our website uses Google Conversion Tracking. Google AdWords will set a cookie on your computer if you have reached our website via an ad provided by Google. The conversion tracking cookie is set when a user clicks on an ad provided by Google. These cookies become invalid after 30 days and are not used for personal identification. We and Google can recognize that a user has clicked on an ad and was redirected to this page if a user visits certain pages of our website while the cookie is still valid. Each Google AdWords advertiser gets a different cookie. Thus cookies cannot be tracked through the websites of AdWords customers. The information gathered by conversion cookies is used to generate conversion statistics for AdWords advertisers who have opted for conversion tracking. Advertisers are told the total number of users that have clicked on their ad and were redirected to a page with a conversion tracking tag. f. Embedded YouTube videos

We have embedded YouTube videos on some of our websites. The corresponding plug-ins are operated by YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. 2. Active use of our website

a. Registration of a user account

You can create a user account for the use of our online shop. It requires your registration. You must enter your salutation, first name, last name, company name, address, e-mail address, telephone number, and a user name and password of your choice. Optionally you can also specify your department, PO box address, VAT number, and fax number. After successful registration, you can make purchases through your user account. Registered users can change or delete data specified during registration at any time.
The legal basis for processing your data for the above purposes is:

  • Art. 6(1)(b) GDPR for the fulfilment of a contract or for taking pre-contractual measures, if you are using your user account for purchases in our online shop; and
  • Art. 6(1)(f) GDPR for safeguarding our legitimate interests. Our legitimate interest is the provision of a user-friendly and personalized website.

b. User requests

We process the personal data you have provided in connection with your inquiries, e.g. when using the contact form, the catalogue request form or when sending a mail to our e-mail address.
You must provide your first name, surname and e-mail address when sending inquiries via the contact form. Entering your address is optional.
Inquiries via our catalogue request form require you to provide your company name, your contact person, your address, your e-mail address, your telephone number, your first and last name, your e-mail address and your telephone number. Entering industry the fax number is optional.
We process your e-mail address and other information provided as part of a message or request sent to one of our e-mail addresses so we can provide you with a response.
The legal basis for processing your personal data in response to user requests is:

  • Art. 6(1)(f) GDPR for safeguarding our legitimate interests; our legitimate interest is the proper answering of customer inquiries.

c. Advertising use

Newsletter
We use your data with your consent for transmitting our newsletter. We will collect, as mandatory information, your e-mail address, and your name and address when you sign up for our newsletter on our website. This information is used to constantly improve our offer and to make it user friendly, so that we can approach you individually in the future and inform you about products that suit you best and make advertising more meaningful and interesting to you.
We use the “Double opt-in” procedure to verify that an application actually was made by the owner of an e-mail address. This involves recording the newsletter subscription, the dispatch of the confirmation mail and the receipt of the requested answer. No other data is collected. The data will be used exclusively for sending the newsletter and will not be shared with third parties.
You can revoke a consent once given with effect for the future at any time. The revocation of a consent does not affect the legality of the processing carried out on the basis of such a consent until its revocation. Using data for e-mail advertising and right to object
We reserve the right to regularly e-mail you interesting offers for similar products from our range of products if we receive your e-mail address in connection with the conclusion of a contract and the provision of products, provided you did not object to it. You may object to this use of your e-mail address at any time by sending a message to the contact details provided under Section I or by clicking the designated unsubscribe link in the advertising mail without this incurring any costs other than the transmission costs according to the basic tariffs.
The legal basis for sending e-mail advertising as described above is:

  • Art. 6(1)(b) GDPR in conjunction with Section 7(3) German Unfair Competition Law (UWG) if you have provided your e-mail address in connection with the purchase of goods or services or if we send you personalized advertising in order to safeguard our legitimate interests; our legitimate interests are the implementation of advertising measures and providing targeted advertising, which in turn is based on our economic interests.

d. Online shop and ordering process

Within our online shop, you can place an order for a product from our assortment. Within our online shop, you can put items from our assortment into the shopping cart. The shopping cart stores all items and their quantity. To simplify the order process, we also store incomplete orders so you can complete them on your next visit.
When you order goods in our online store, we collect personal data when accepting the order as part of online trading, so we can process the order and ship the ordered goods. You can place an order in our online shop only as a registered user of a user account (see Clause III.2.a.).
The legal basis for processing your data for the above purpose is:

  • Art. 6(1)(b) GDPR for the initiation and execution of contracts, in particular the preparation of offers, the fulfilment and processing of your order, and the administration of the customer relationship.

e. Compliance with legal regulations

We also process your personal data to fulfil other statutory obligations we have in connection with the processing of an order. These include in particular commercial, trade or tax retention periods.
The legal basis for processing your personal data is:

  • Art. 6(1)(c) GDPR in connection with commercial, trade or tax law when fulfilling a statutory obligation to the extent we are obliged to record and store your data.

f. Enforcement of laws

We also process your personal data to assert our rights and enforce our legal claims. We also process your personal data to defend ourselves against legal claims. Finally, we process your personal data as is necessary to prevent or prosecute crimes.
The legal basis for processing your personal data for these purposes is:

  • Art. 6(1)(f) GDPR for safeguarding our legitimate interests to the extent we assert legal claims, defend ourselves in legal disputes, or prevent or solve criminal offenses.

IV. Links

Some sections of our websites contain links to third-party websites. These websites are subject to their own privacy policy. We are not responsible for their operation, including data handling. You should review the privacy statements of those third-party sites before sending information that may be associated with you to or through such sites.

V. Categories of recipients

First of all, our employees obtain knowledge of your personal data. We also use carefully selected and commissioned service providers for some of our business processes, in particular IT services, the execution of contracts, the maintenance of customer relations and the provision of services to customers and interested parties. Our service providers may receive your personal data as a processor, which means they are strictly bound by our instructions in handling your personal data. Recipients may also independently handle data transmit by us.
Here are some additional categories of recipients of your personal data: Logistics service providers, suppliers, collection service providers, advertising and market research service providers, printing service providers.

VI. Third country transfer

We will transfer your truncated IP address to the United States in the context of using Google tools. The data transfer is based on the Implementing Decision (EU) 2016/1250 of 12 July 2016 pursuant to Directive 95/46/EC of the European Parliament and of the Council on the adequacy of protection provided by the EU-US Privacy Shield.
We do not transfer your personal data to countries outside the EU or the EEA or to international organizations.

VII. Duration of storage

We delete your personal data if it is no longer needed for a business relationship, in particular for the initiation and execution of contracts, provided there are no statutory retention requirements or statutory justifications. The retention periods laid specified in the German Commercial Code (HGB) and the German Tax Code (AO) are six to ten years. Statutory limitation periods also influence the retention time. Sections 195 ff. German Civil Code (BGB) specify the regular limitation period to be three years, but the limitation period can also be thirty years in certain cases.

VIII. SSL encryption

We use state-of-the-art encryption techniques (such as SSL) via HTTPS to protect the security of your data during transmission.

Furthermore, statutory provisions give you a right to rectification (Art. 16 GDPR), deletion (Art. 17 GDPR), limitation of processing (Art. 18 GDPR), as well as data transfer (Art. 20 GDPR).

Right to object
Art. 21(1) GDPR entitles you object at any time to any processing of data we perform pursuant to Art. 6(1)(f) GDPR (on the basis of weighing of interests) for personal reasons. In particular, you may object to using your data for direct mail purposes at any time, effecting the future use of your data.

Right of revocation
You can revoke a consent once given without giving any reason at any time. The revocation of a consent does not affect the legality of the processing carried out on the basis of such a consent until its revocation.

Asserting of rights
You can assert the aforementioned rights in writing to the Data Protection Officer of our company, whose name and contact details are provided in Section II.
Please note that we reserve the right to require additional evidence of your identity as the actual data subject claiming the rights hereunder if there are any doubts that you are asserting these rights as the actual data subject.

XI. Scope of your duties to provide data

In principle, you are not obliged to provide us with your personal data. However, if you do not so, we will not be able to provide you with our website, respond to your requests or enter contracts with you. Mandatory personal data are marked with an “*”; any other personal data that you may provide is voluntary information.

XII. Automated decision-making / Profiling

We do not use automated decision-making or profiling (an automated analysis of your personal circumstances).


Information about your right to object pursuant to Art. 21 GDPR

  • 1. You may, at any time, object for personal reasons to any processing of your data that is based on Art. 6(1)(f) GDPR (data processing based on weighing of interests) or Art. 6(1)(e) GDPR (data processing in the public interest). This also applies to profiling based on this provision within the meaning of Art. 4(4) GDPR.
    We will no longer process your personal data when you file a complaint unless we can demonstrate mandatory protective reasons for processing such data that outweigh your interests, rights and freedoms, or the processing is required for enforcing, exercising or defending legal claims.
  • 2. In individual cases, we may also process your personal data for direct mailing. You can object to any direct mailing at any time if you do not wish to receive any advertising; this also applies to profiling to the extent it is associated with such direct mailings. We will comply with such an objection for the future.
    We will no longer process your data for direct marketing purposes if you object to the processing for such purposes.

There is no required form for an objection, which should be addressed to the contact data provided in Section I, if possible.


XIII. Change of our privacy policy

We may change this privacy policy from time to time to ensure it complies with current legal requirements or to implement in the Privacy Policy any changes we have made to our services, such as when introducing new services.
